A Drone Ban Again, but this Time Differrent
The United States is talking about banning my drone again — but the language changed this time. It isn't aimed at a brand or a flag anymore. This round targets what a drone can do: thermal imaging, LiDAR, autonomous tracking. Capability, not country of origin. And I fly exactly the kind of aircraft they're now calling "military-grade." I hold a Pilot Certificate for Advanced Operations in Canada and I operate a DJI Matrice 4T, so here's the ground truth from someone who actually flies one — and why banning is the wrong lever to pull.

What's actually being proposed
The earlier fights were about DJI specifically — the Countering CCP Drones Act, the NDAA security-audit clause, DJI landing on the FCC's Covered List at the end of 2025. This is different. On July 21, 2026, the Federal Communications Commission — not the FAA — proposed banning the import and sale of foreign-made drones it deems "military-grade." The named categories: swarming drones, drones built to carry defense articles, aerosol/spray drones, docking stations, anything 25 kg (55 lb) and up — and, the two that matter for most of us, thermal-imaging drones and drones with LiDAR.
Notice what defines the net. Not the logo, not the country — the sensor package. A thermal camera is what earns the label now.
π The tell: this proposal would ban drones the FCC already authorized — the same units, reclassified. Yesterday's approved commercial tool becomes today's "military-grade" hardware without a single bolt changing. When the definition moves and the machine doesn't, the definition is the story.
If you operate, this isn't a spectator sport: public comments are open in PS Docket No. 26-189 until September 2, 2026. That's the table to speak at before it's decided for you.
What a drone like this actually does
I'll be honest about the capability, because pretending it's a toy helps no one. The Matrice 4T carries three 48-megapixel cameras — wide, medium tele, and tele — plus a 640×512 thermal sensor that pushes to a 1280×1024 high-res mode, a near-infrared spotlight good for roughly 100 m, and a laser rangefinder. The tele stack reaches up to 128× hybrid zoom. Built-in RTK pins its position to about a centimetre. It stays up for nearly 49 minutes on a charge. In Canada I fly it well within the 122 m (400 ft) ceiling the rules impose — the airframe itself could climb far past that, which is exactly the "hard limit lives in the software" point.
Here's what that adds up to in the field. Lift off, and a responsive touchscreen shows you an aerial view of a wide area with the AI already counting: people, how many are moving, vehicles. Draw a box around a person, a cyclist, a car — tap once and it locks on; tap again and it follows. The drone often doesn't physically chase anything. It rides that enormous zoom, holding the subject from a distance while they have zero idea they're being watched. Lose the target behind trees or a building and it zooms out, predicts the heading, and re-acquires the moment they reappear. Only when it hits the zoom limit does it start to move.
At night it's another animal. Zoom into the moon and count craters. Flip to infrared from a couple hundred metres up and pick out a pair of rats crossing a back yard. Thermal even leaves a time signature: a parking spot still glowing where a car sat, a warm rectangle where a BBQ used to be, a hood radiating heat because the vehicle pulled in minutes ago. This is a genuine surveillance platform, shipped in a case, sold to whoever can cover the invoice.
Powerful isn't a reason to ban it
Do I think this belongs in just anyone's hands, no questions asked? No. But "powerful" and "prohibited" aren't the same word. A knife is powerful. Nearly everyone who owns one uses it to cook or make things and never once entertains another use — but a few people ruin it for everybody, and we don't respond by banning knives. We treat the tool with respect and we hold the misuse accountable. Advanced drones deserve the same posture: respect the capability, gate it behind competence, and come down hard on the people who abuse it — not on the tool or the tens of thousands of operators using it responsibly.
The real problem: the 250-gram gap nobody explains
These aircraft are absurdly accessible. You can walk into a big-box store and walk out same-day with a capable drone; the exotic setups are a boat-ride away, and even then you often wait on the shipping only because the batteries travel by sea. Prices have fallen off a cliff — the gap between a toy and an enterprise rig is real, but it's the only barrier left, and it's shrinking while the hobby tier keeps getting smarter.
What hasn't kept pace is anyone telling buyers the rules. A store will sell almost anyone a drone over 250 grams without a word. Why does 250 grams matter? Because that's the line. Under it, you're in the lightest-regulation category — no certificate, no registration, far fewer restrictions. At 250 g and up, you need a pilot certificate, you must register the aircraft, and the penalties get real: Transport Canada can levy up to $1,000 for flying without the required certificate, up to $3,000 for flying where you shouldn't or endangering people and aircraft, and up to $25,000 for a knowing violation. Most buyers have no idea any of this exists.
π Under 250 g is lighter rules, not a free pass: no certificate or registration required — but you're still bound by the Criminal Code, provincial privacy law, and every restricted or no-fly zone. Sub-250 grams protects you from paperwork, not from consequences.
License the capability, don't ban the machine
So here's what I'd actually build instead of a ban. Make licensing mandatory before purchase for anything over 250 grams — and tier the licensing to the technology the drone carries. Flying a thermal, autonomous-tracking platform should demand demonstrated maturity and responsibility the same way heavier or more capable aircraft demand more of a pilot. Prove you can be trusted with the privilege, then buy the tool.
Pair it with registration that does double duty. Yes, accountability — a registered airframe and a certified pilot mean there's a name attached when something goes wrong, which is exactly the gap that broadcast standards like Remote ID are meant to close (I got into that side of things in Drone? Drone!). But registration could also be a resource pool. A wildfire breaks out and someone needs reconnaissance. A hiker goes missing and a search team needs eyes. A film shoot needs a certified operator for the afternoon. Imagine a rolodex of vetted, capable pilots who already own the right hardware, ready to be called. That's the opposite of a knee-jerk prohibition — it turns operators into infrastructure.
Why I got into this
This isn't abstract for me. A few years back I was hit by a car as a pedestrian, and the injuries have taken their toll. Becoming a drone operator looked like a genuine path back into work — something I could do, on my terms, that was actually useful. The neighbour's dog bolts and nobody can find it. North Shore Rescue needs help locating a stranded hiker. A local emergency ties up resources an ER is short on. In most of those cases I'd volunteer; in some, a suggested gift comes my way afterward — cash works, though I won't turn down a good dinner either.
The part worth underlining: before I pursued the certificate, I was naΓ―ve about all of it. I'd never have known about the 250-gram line, that you can't fly over people, that you stay clear of active emergency-response areas. Getting licensed taught me every bit of that — I studied, failed the exam the first time, went back and missed a single question for a 98%. And it didn't stop with me. The knowledge trickled out to everyone around me; now the people close to me know these rules too. That domino effect is what real education does — and it's exactly what a store transaction with no strings attached can never do.
Real concern, or convenient theater?
Which brings me to the thing I can't quite shake. Is this genuine national-security concern, or the same movie on repeat? We've seen the pattern before: a serious-sounding announcement, a wave of panic, a back-and-forth with no clear decision, and eventually someone yells "psyche!" and the ban never lands. It'd be a convenient game to play if the royal "you" — you, your friends, your family — happened to be buying and selling certain drone stocks around each swing of the news. Not that anyone would know anything about that. Are we watching it again? Nah. The drones are just too powerful.
And the irony is the tech isn't slowing down for anyone's paperwork. DARPA just ran its LIFT Challenge, hunting drone designs that haul more than four times their own weight — heavy-lift for disaster response and infrastructure work, the exact civilian good this capability enables. Ban the category and you don't stop the technology; you just decide who's allowed to be good at it. I'd rather we license the pilots, respect the tool, and punish the misuse. Ban the behavior, not the machine.

- The US roster of communications equipment deemed a national-security risk; landing on it blocks new authorizations to import or sell.
- Sub-250 g category
- Drones under 250 grams, exempt from registration and pilot certification — but still bound by privacy law, the Criminal Code, and airspace rules.
